§ 18.016. Enforcement.

  • (a)

    It shall be the duty of the City Manager to administer and enforce the provisions of the Subdivision Regulations.

    (b)

    When a violation is discovered, the City Manager may serve a written "stop work" order directing the immediate discontinuation of construction or use of land or a structure that is a violation of these regulations or requiring the correction of any violation of these regulations within fourteen days of the date the order is served.

    (c)

    The order may be served upon the property owner or any other person who commits or assists in any such violation. The order may be served in person, by certified mail, or by posting at the site of the violation.

    (d)

    If the construction or use of land or a structure that is a violation of these regulations is not immediately discontinued following service of a written order directing the same or if a violation is not corrected by the time required by the written order, the City Manager shall notify the City Council and the City Council shall decide whether the City Attorney, acting on behalf of the City of Kotzebue, may maintain an action for such legal and/or equitable relief as may be necessary to enforce these regulations.

    (e)

    Nothing contained herein shall prevent the City from taking such other lawful action as is necessary to prevent or remedy any violation.

    (f)

    Written orders of the City Manager may be appealed to the Board of Adjustment as provided in 18.015.
