§ 18.035. CITY CENTER AREA

  • A City Center Area is created for the application of these regulations. This City Center Area is generally defined as the area of the City bounded on the west and north by the Kotzebue Sound, on the northeast by the westerly boundary of North Tent City, then connecting with the easterly lot line of Towers A, B and C running in a north/south direction from North Tent City to just south of Tower Street and turning easterly along the northern lot lines of Lots 9, 10, 11, 12 and 13 of Block 16, USS 4498 and Lot 5, Block 20 USS 4498 and then turning in a southerly direction along the eastern boundary of Lot 5, Block 20 USS 4498 and proceeding across Caribou Drive to the easterly boundary of Lot 4, Block 20 USS 4498 and then turning in a westerly direction along the southern boundary of Lot 4, Block 20 USS 4498 and then turning in a southerly direction at the easterly boundary of Lot 1, Block 19, USS 4498 across the end of Puffin Way and proceeding along that line to and across Turf Street and then turning in an easterly direction to the eastern boundary of the City Center Area which is Kotzebue Lagoon and continuing onto the northerly boundary of the Kotzebue Airport which is the southerly boundary of the City Center Area.

    (a)

    Purpose: The purpose of creating this City Center Area is to take into account the extensive, existing development of this area over the past several decades and the historical and cultural significance of this area.

    (b)

    Effect: The minimum residential access to public rights-of-way, residential lot size, residential lot length and residential width requirements of subsections 18.150(a), 18.150(c)(1), 18.150(c)(2), 18.250(a), 18.250(e)(1) and 18.250(e)(2) shall not be applied to lots in the City Center Area unless such requirements are clearly necessary for public health and safety, in which case the Planning Commission shall make specific, detailed findings of fact which support the application of the above-referenced requirements to lots in the City Center Area. Economic and social hardship to the subdivider shall not be taken into account when such findings of fact are made.
