§ 3.16.110. Disbursement setoffs for moneys owed city.

    Disbursement of moneys to a person, firm, or corporation will be made only after the various receivable accounts of the general government and municipal utilities funds have been reviewed for outstanding balances owed, the disbursement will be reduced by setting off the amount of indebtedness due to the city from such person, firm, or corporations.

    B.

    All contracts to which the city is a party which will or may involve the disbursement of city funds shall contain the following clause or its substantial equivalent: "Disbursement of moneys by the City of Kotzebue thereunder shall be subject to setoff pursuant to the provisions of Section 3.16.110 of the Kotzebue Municipal Code." Such contracts include, but are not limited to, oral contracts, employment contracts, construction contracts, purchasing contracts, and contracts of the municipal utilities system, including customer's deposits.
